Communal activities

The field of communal activities includes the provision of communal services in the area of water supply and municipal wastewater management, public water supply, stormwater management, municipal waste management, public lighting management, maintenance of municipal roads and bicycle paths, cemetery maintenance, market maintenance, maintenance of public toilets, care about abandoned and lost animals and pets, maintenance and use of communal infrastructure, waste processing and disposal, waste collection, waste transport.
License conditions
A license may be issued to a person who performs the above-mentioned activities if he meets the following requirements in terms of personnel qualifications, i.e. if he has:
- the technical director, that is, another person who leads and is responsible for the process of management, maintenance and development;
- the chief technologist for the preparation of drinking water, that is, another person who directly manages the process of preparing drinking water, if he manages a plant for the treatment of drinking water;
- the chief technologist for wastewater treatment, that is, another person who directly manages the process of wastewater treatment, if he manages a plant for municipal wastewater treatment;
- benchmarking coordinator;
- other employees with appropriate qualifications in order to fulfill the requirements regarding the quality of the service provided;
- for pumping and removal and disposal of waste water from septic tanks, a person qualified to manage and trained to operate a vehicle for pumping, removal and disposal of waste water from septic tanks.
A license may be issued to a person who performs the aforementioned activities if he meets the following conditions in terms of technical equipment, i.e. if he has:
- specialized equipment necessary for the performance of regulated utility activities, which can be owned or leased and which is prescribed by Annex 1 of the aforementioned rules.
The performance of utility activities can be entrusted to persons if they are registered in the Central Register of Business Entities and meet the requirements in terms of personnel and technical equipment.
It is prescribed that the fulfillment of the mentioned conditions (except for regulated communal activities, activities from Article 3, points 10, 11 and 13 of the Law, as well as activities for which the fulfillment of the conditions is prescribed by a separate law) is determined by a decision issued by the state administration department responsible for communal activities ( Ministry).
- Determining the fulfillment of the conditions for the performance of the mentioned communal activities is prescribed by the Rulebook on the conditions for the performance of communal activities ("Official Gazette of the Republic of Montenegro", number 54/20), which prescribes the conditions of technical equipment in terms of appropriate mechanization, machines, equipment and appropriate space, as well as the conditions related to personnel training.
- A person who performs communal services should own, lease or use the necessary equipment and appropriate space depending on the activity he performs.
- In terms of personnel capacity, a person performing communal activities should have a certain number of employees who enable the smooth performance of work, which is proven by employment contracts concluded with employees or contracts on business and technical cooperation or by other persons engaged if required. by special law.
- In addition to the employees directly related to the performance of the activity, the person performing the utility activity should provide at least the following personnel: (i) lawyers for the performance of legal activities (VII1 and VII2 qualification levels); an economist to perform economic, accounting and financial tasks (V, VII1 and VII2 qualification levels), one person with appropriate education to perform cashier duties (IV!/V qualification level or higher education diploma VI qualification level), one person to perform administrative-technical pospva (level IV qualification) as well as one cleaning worker.
- The following minimum technical equipment is required for the management of storm water (based on ownership, leasing or rental): high-pressure auto-cistern for purification of storm sewers; pump for purifying and pumping rainwater from clogged storm sewers; a vehicle for inspecting the state of atmospheric sewage; and hand tools. In terms of personnel, the number of executors is: one construction or mechanical technician; a certain number of direct executors of the III/II/I level of qualifications for the maintenance of storm sewers determined according to the criteria from paragraph 1 of this point; one driver.
For the maintenance of public areas, the following minimum technical equipment is required (based on the right of ownership, leasing or lease): car cleaner, car cleaner, loading shovel, snow removal vehicle or appropriate attachments for a standard work vehicle, except in municipalities where snow is not retained on public areas, a snow plow, except in municipalities where snow is not retained on public areas, a leaf blower from public areas, a vehicle for transporting workers, a fully equipped cart with tools (broom, shovel, rake, etc.), i.e. for public green areas : lawnmower, hedge trimmer, tractor with trailer, motor cultivator/self-propelled tiller for cultivating small areas of land, vehicle with crane/basket for pruning trees, combined tools for mowing grass and clearing bushes, motor and extended saw for felling trees, leaf blower, branch crusher, sprayers for chemical treatment of plants, vehicle for transporting workers, hand tools. The required staff is determined on the basis of the area maintained by the person performing communal activities.
- Necessary in the following personnel: one employee for the supervision of technical profession IV1 qualification level; a certain number of direct executors of the II/I level of classification for maintaining cleanliness in public areas determined according to the criteria from paragraph 1 para. 1 and 2 of this point; one driver per 10 direct executors from paragraph 1 para. 1 and 2 of this point, i.e. for public green areas: one forestry engineer majoring in landscape architecture or general major, i.e. agricultural engineer majoring in horticulture or similar; one worker for the supervision of SSS forestry, agricultural or technical profession; a certain number of direct executors for arranging public green areas, III/II/I level of qualifications, determined according to the criteria from paragraph 1 indent 3 of this item; one driver per 10 direct executors.
- The following equipment is required for the management of public lighting: a vehicle for touring the field, a vehicle with a basket for the maintenance of public lighting, a vehicle for transporting workers and materials, the necessary tools and the following personnel skills: one executor for 1,200 lighting fixtures; or one executor for 900 public lighting poles, one person with IV1 qualification level, major - electrical engineering, a certain number of direct executors of the electrical profession determined according to the criteria from paragraph 1 of this point, of all qualification levels of the said profession, one driver for 10 executors.
- The following equipment is required for road maintenance: dump truck, combination machine, loader, bulldozer, excavator, paver, vibratory roller, horizontal signaling machine, salt spreader, snow plow, vibrating plate with forward movement (vibro frog), asphalt cutter and concrete and the following staff: one graduate civil or mechanical engineer, two construction technicians, one electrical technician, the corresponding number of IV2 and/or III qualification level workers of various professions and I1 qualification level workers, according to the criteria from paragraph 1 of this point. three drivers.
- The minimal technical equipment that should be possessed by the person performing the communal activity of maintaining watercourses of local importance consists of: tipper truck, excavator, bulldozer, hedge trimmer.
- The person who manages public parking spaces should have at least the following equipment: closed or open space with a surface of at least 200 m2, one stand-alone device for charging services and/or a mobile fiscal cash register; one device for reading vehicles parked in numbered parking spaces, upon registration by SMS; one vehicle for compliance control and collection. In terms of personnel, it is necessary to provide: two workers for collection and supervision of public parking spaces and public garages; one employee of the I1/I2 level of qualification for the maintenance of public parking spaces and public garages.
- The minimum technical equipment of a person who takes care of abandoned and lost animals and maintains a shelter for their care consists of: space of at least 50 m2, with boarding houses for housing animals built in accordance with regulations (asylum); one vehicle for catching abandoned pets that move freely, equipped with appropriate tools, one vehicle for transporting and removing dead animals and other waste of animal origin. In terms of personnel training, it is necessary to provide: three workers of II or I2 qualification level for working in the asylum (feeding animals and cleaning animal boxes), one worker of II or I2 qualification level for catching abandoned animals, who, when not in the field, helps in the asylum ; one veterinary technician and one driver.
- Pursuant to the Law on Waste Management ("Official Gazette of Montenegro", No. 64/11 and 39/16), processing and/or disposal of waste can be carried out by a company or an entrepreneur if it has the appropriate equipment, a waste processing plant and the required number of employees, on based on the permit for processing, i.e. disposal (removal) of waste issued by the Environmental Protection Agency. The agency determines the fulfillment of the requirements for processing and/or disposal activities and issues the aforementioned decision. The decision is issued based on a request submitted by a person who performs or intends to perform the activity of processing and/or waste disposal.
The conditions to be met by a business company or an entrepreneur for waste processing and/or disposal are defined by the Rulebook on conditions to be met by a business company or an entrepreneur for waste processing and/or disposal ("Official Gazette of Montenegro", number 53/12), adopted based on Art. 31 and 33 of the Waste Management Act). In terms of technical equipment, that person should meet the following requirements, i.e. they should have: waste processing equipment, an electronic scale for measuring the mass of vehicles with and without waste when receiving waste at the plant, or a scale for measuring the mass of waste delivered in containers or vessels for plants whose capacity is less than 10 t per day or less than 2000 t per year; scales for measuring the mass of processed waste and measuring the mass of residues from waste processing, computer equipment for the electronic issuance of certificates of the quantity before collected waste and equipment for washing vehicle wheels before leaving the public road. In terms of spatial assumptions, the following conditions should be provided: space for receiving and collecting collected waste; space for the storage of collected waste, space for the preliminary processing of waste before its processing and removal, post for processing and removal of waste; space for storage and shipment of processing or waste disposal residues; space for storage and shipment of processed waste and premises for the plant manager.
In terms of employees, the person who performs the above-mentioned activity should employ a manager of a waste treatment plant with a perfect university degree. VII degree of technical direction and at least five years of work experience in the profession and at least one employed person with a completed at least III degree of vocational education in the tasks of reception and collection of accepted waste, processing and disposal of waste and management of the rest of processing or waste disposal.
- Pursuant to the aforementioned rulebook, waste collection and transport can be carried out by a company or entrepreneur if it has equipment for waste collection and transport and the required number of employees. The conditions to be met by the person performing the above activities are defined by the Rulebook on the conditions to be met by a business company, i.e. an entrepreneur for the collection and transport of waste ("Official Gazette of Montenegro"; number 16/13).
The person collecting waste (collector) in terms of equipment should have: 1) suitable containers for collecting and temporarily storing waste; 2) means of transport; 3) means for handling waste; 4) an electronic scale for measuring the mass of vehicles with and without waste, when receiving waste in a temporary warehouse or a scale for measuring the mass of waste that is delivered or shipped from a temporary warehouse in containers or vessels, and whose capacity is less than 10t per day or less than 2000t per year; 5) electronic equipment for issuing certificates on the amount of waste collected and the amount of waste delivered to the processing plant; 6) equipment for washing vehicles, means and equipment for waste collection; 7) temporary storage for separate temporary storage of types of waste or recycling center for separate collection of municipal waste fractions, if no contract has been concluded for the delivery of collected waste to a waste treatment facility.
The person who transports waste (carrier) in terms of equipment should have: 1) at least two vehicles for transporting waste of separately collected types of waste, owned or leased; 2) electronic equipment for issuing certificates on the amount of collected waste and the amount of waste submitted for temporary storage or processing; and 3) equipment for washing vehicles for transporting waste in the property or concluded a contract for washing vehicles with a business company or entrepreneur that washes vehicles.
In terms of the number of employees, the collector of non-hazardous and communal waste should have an employed manager with at least V level qualification from the sector: (natural sciences, engineering and production technologies, agriculture, nutrition and veterinary medicine, health and social protection or mining, metallurgy and chemical industry ) with at least five years of work experience in the profession and at least one person employed to perform waste collection tasks with at least the III level of qualification completed. The collector of hazardous waste, except municipal waste, should have an employed manager who has completed at least the VII level of qualification from the sector: (natural sciences, engineering and production technologies, agriculture, food and veterinary medicine, health and social protection or mining, metallurgy and chemical industry) with at least five years of work experience in the profession and at least one person employed to perform waste collection tasks with at least the III level of qualification completed. A transporter of hazardous waste should have an employed manager with at least a V level qualification from the following sectors: (natural sciences, engineering and production technologies, agriculture, food and veterinary medicine, health and social protection or mining, metallurgy and chemical agents.

Permits
- In the area of municipal waste water management, the Agency issues licenses for: acceptance and disposal of household waste water and water of similar composition through public sewers, i.e. pre-treated waste water generated during the production process that is discharged into the public sewage network for waste water and their discharge into the recipient; management and operation of municipal waste water treatment facilities and pumping, removal and disposal of waste water from septic tanks;
- The request for issuing a license is submitted to the Agency on the form prescribed by the Rules on licenses for the performance of regulated utility activities
- The license is issued to the person referred to in Article 20 paragraph 1 of the Law on Communal Activities ("Official Gazette of Montenegro", no. 55/16; 66/19 and 140/22): (i) a company with the capacity of a legal entity founded by a local self-government unit; (ii) a business company with the capacity of a legal entity in private ownership or an entrepreneur; (iii) a business company with the status of a legal entity in the majority ownership of the state, which is established by the Government, and (iv) a business company with the status of a legal entity, which is jointly established by the Government and a unit of local self-government.

Permits
- In the area of municipal waste water management, the Agency issues licenses for: acceptance and disposal of household waste water and water of similar composition through public sewers, i.e. pre-treated waste water generated during the production process that is discharged into the public sewage network for waste water and their discharge into the recipient; management and operation of municipal waste water treatment facilities and pumping, removal and disposal of waste water from septic tanks;
- The request for issuing a license is submitted to the Agency on the form prescribed by the Rules on licenses for the performance of regulated utility activities
- The license is issued to the person referred to in Article 20 paragraph 1 of the Law on Communal Activities ("Official Gazette of Montenegro", no. 55/16; 66/19 and 140/22): (i) a company with the capacity of a legal entity founded by a local self-government unit; (ii) a business company with the capacity of a legal entity in private ownership or an entrepreneur; (iii) a business company with the status of a legal entity in the majority ownership of the state, which is established by the Government, and (iv) a business company with the status of a legal entity, which is jointly established by the Government and a unit of local self-government.
