Conditions for performing activities in the field of social and child protection
Issuance of licenses to providers of social and child protection services
Ministry of Labor and Social Welfare - Directorate for Social Welfare and Child Protection - Directorate for Development of Services and Professional Supervision of Social and Child Protection Institutions in accordance with the Law on Social and Child Protection ("Official Gazette of Montenegro", No. 27/13, 1/15, 42/15, 47/15, 56/16, 66/16, 1/17, 31/17, 42/17, 50/17, 59/21, 145/21 and 3/23), competent is for the issuance of a license for the performance of social and child protection activities to service providers, for a period of six years. And for services in the field of social and child protection:
1) support for life in the community;
2) advisory-therapeutic and social-educational service;
3) accommodation.
A license to perform activities is issued to a service provider who:
1) is registered in the Register;
2) meets the standards for the provision of the service for which the license is requested, which relate to: location, space, equipment, number and type of professional staff and service provision program.

Conditions for performing activities in the field of social and child protection
Issuance of licenses to providers of social and child protection services
The request for issuing a license is submitted by the service provider to the Ministry of Labor and Social Welfare and the following is attached to the request:
1) decision that the service provider is registered in the appropriate Register;
2) foundation act;
3) statute;
4) act on internal organization and systematization of workplaces, if there are more than ten employees;
5) work license for professionals;
6) employment contract or other contract concluded with a professional worker, professional associate and associate;
7) the basis of the right to use the facility and a sketch of the space where the service is provided;
8) service provision program (number of users, assessment, planning and activities for providing a specific service);
9) procedures provided by the service provider in accordance with the regulation regulating the detailed conditions for the provision and use of the service, as well as the norms and minimum standards of the service for which the application for the issuance of a license is submitted;
10) proof of payment of the administrative fee, in accordance with the law.
In addition to the above-mentioned evidence, the provider of the accommodation service in an institution, reception center, drop-in center and day care center is also obliged to submit:
1) list of equipment, proof of provided sanitary-technical and hygienic conditions for work;
2) expert opinion, that is, a report on the performed inspections and tests of work equipment with the assessment that the prescribed safety and health measures at work are provided; and
3) proof of compliance with fire protection conditions.
The request is submitted on form ZL-1.
NOTE: Based on the Law on Administrative Fees, exemptions from paying the fee are:
- state bodies, state administration bodies, municipal bodies and local administration bodies;
- The Pension and Disability Insurance Fund of Montenegro, the Health Insurance Fund of Montenegro and the Employment Institute of Montenegro;
- institutions in the field of health, science, culture and social and child protection, founded by the state;
- institutions in the field of education, whose founder is the state, except for fees prescribed in tariff number 9;
- red cross organizations and other humanitarian organizations;
- foreign citizens and foreign countries, in accordance with a confirmed international agreement or under the condition of reciprocity;
- unemployed persons, persons with disabilities and beneficiaries of material family security in accordance with the law governing social and child protection;
- family accommodation-fostering and family accommodation service providers;
- non-governmental organizations to achieve the goals for which they were founded;
- other persons, organizations, institutions, bodies if the exemption is established by a special law.
Issuing a license to a family accommodation - foster care service provider and a family accommodation service provider
The provider of family accommodation - foster care and the provider of family accommodation submit an application for the issuance of a license to the Center for Social Work.
The Center for Social Work issues a license to the service provider, if he has been assessed as eligible and has successfully completed training for the provision of family accommodation - foster care and family accommodation.
The request is submitted on the ZL-2 form.
Qualification requirements
The Law on Social and Child Protection stipulates that professional workers are: social worker, psychologist, pedagogue, andragogist, special pedagogue, lawyer, sociologist, defectologist, special educator, rehabilitator and doctor of medicine.
Professional associates are persons of another profession, with higher education, who perform work at the service provider.
Associates are persons with secondary education, who perform work at the service provider.
A work license for professional workers is issued for performing:
1) basic professional jobs in social and child protection;
2) specialized professional jobs in social and child protection;
3) legal affairs;
4) planning and development work;
5) work of educators;
6) work of a work-occupational therapist.
Professional workers at the service provider must have a license to work. The license is issued for a period of six years and is renewed in accordance with this Law.
Health care regulations apply to the issuance, renewal and revocation of a medical doctor's license.
Conditions for issuing a work license
A work license is issued to a professional worker who:
1) has an appropriate professional qualification and has passed a professional exam in accordance with this law;
2) has a certificate that he has successfully completed an accredited training program.
The request for issuing, renewing and revoking a work license is decided in the first instance by the Institute for Social and Child Protection.
Application and documentation for the issuance of a work license
A professional worker submits an application for the issuance of a work license to the Institute for Social and Child Protection.
With the request, the professional worker attaches:
1) diploma or other proof of completed studies VII-1 level of qualifications in social work, psychology, pedagogy, andragogy, special pedagogy, legal sciences, sociology and defectology;
2) certificate of successfully completed accredited training program, ie service provision program;
3) certificate of passing the professional exam.
The request is submitted on the ZIL form.
Program for passing the professional exam
The professional exam for professional workers in the field of social and child protection consists of a general and a special part.
The general part is taken orally according to the program that contains the following subjects:
- Basics of constitutional arrangement;
- Basics of labor relations;
- Basics of administrative procedure;
- Basics of social and child protection;
The special part of the professional exam includes a practical test of knowledge and is taken orally.
How to apply for the professional exam
Form: Application for passing the professional exam (www.gov.me)
The application for taking the professional exam is submitted to the Ministry of Labor and Social Welfare, Rimski trg no. 46, Podgorica. Along with the application, the candidate is required to attach evidence of meeting the requirements for taking the professional exam:
- proof of completed VI or VII1 level of education qualification
- proof of work experience
- ID card photocopy
- the candidate who received his education abroad also submits proof of recognition of the foreign educational document
Candidates will be informed about the fulfillment of the requirements for taking the professional exam, the date, place and time of taking the professional exam no later than 30 days before the day set for taking the professional exam.
NOTE: A candidate who has passed the professional exam for work in state bodies submits appropriate evidence and takes the exam from the general part that refers to social and child protection regulations and the special part of the professional exam.
Costs of passing the professional exam
The costs of taking the professional exam are borne by the candidate, and the costs amount to 15 euros per exam.
Payment of the costs for taking the professional exam is made to payment account 832-966-15 Fee for taking the professional exam in the field of social and child protection - Ministry of Labor and Social Welfare.
The candidate is obliged to submit proof of payment to the secretary of the commission for review before the exam begins.
Method of taking the professional exam
Exam questions for the general and special part of the professional exam are prepared by the Commission, and the professional exam is taken orally.
The candidate's success in the professional exam is evaluated with the grade "passed" or "failed" for each subject. The candidate who, for each subject individually, received the grade "passed" passed.
Exam postponement
At the request of the candidate, taking the professional exam can be postponed for justified reasons.
Make-up exam and retaking the professional exam
A candidate who received a grade of "failed" in one subject at the professional exam has the right to take a make-up exam in that subject.
A candidate who received a grade of "failed" in two or more subjects at the professional exam has the right to retake the exam. The costs of taking the professional exam for retaking are 15 euros per exam.
Payment of the costs for retaking the professional exam is made to payment account 832-966-15 Fee for taking the professional exam in the field of social and child protection - Ministry of Labor and Social Welfare.
