Import and/or export of substances that damage the ozone layer and alternative substances

The import and/or export of substances that damage the ozone layer and alternative substances can be carried out by legal entities and entrepreneurs only on the basis of the permission of the administrative body (Environmental Protection Agency).

License conditions

A permit for the import and/or export of substances that damage the ozone layer and alternative substances is issued based on the request of a legal entity or entrepreneur that contains information on:

1) to the applicant (name and surname, i.e. title, social security number, address, telephone/fax number, e-mail)

2) substances, i.e. substances that are imported/exported, for each substance individually:

– name of the substance (chemical name and trade mark);

– tariff code;

– amount of substance expressed in unit of measure;

- the name of the country of import or export of the substance;

- the name of the country of origin of the substance;

– the manufacturer of the substance.

The following documentation is attached to the request:

- proof of registration in the Central Registry of Business Entities;

– supplier's invoice or pro-invoice;

- notification of the border crossing where import/export will take place;

- notification on the purpose of import/export;

- notification of end users;

- safety data sheet for the substance;

- statement that the storage of substances is carried out in accordance with the safety data sheet for the given substance;

- proof of payment of the administrative fee; and

- other documentation of importance for issuing a permit for the import/export of substances that damage the ozone layer and alternative substances.

For substances for which the annual import quota is determined, the Decision for determining the annual import quota is attached to the import request.

Legal remedies

An appeal against this decision (permit) can be lodged with the Ministry of Tourism, Ecology, Sustainable Development and Development of the North within 15 days from the day it was delivered, and through this authority
