Processing and/or disposal of waste

Processing and/or disposal of waste can be carried out by a company or an entrepreneur if it has appropriate equipment, a waste processing plant and the required number of employees based on a permit for processing or waste disposal.

License conditions

In particular, the request should contain:

  • Information about the applicant (name and address, i.e. name and headquarters),
  • Data on the identification of the facility, i.e. facility for processing and/or disposal of waste (cadastral and urban plot number),
  • Data on the processing and/or disposal procedure and the location where the waste will be processed,
  • The type of waste, in accordance with the waste catalog and waste characteristics,
  • Planned annual quantities (masses) of certain types of waste,
  • Way of transporting waste,
  • Planned period for processing and/or disposal of waste,

The following documentation shall be submitted with the application for the issuance of a permit:

  • Evidence of the applicant's registration in the Central Register of Business Entities (hereinafter referred to as CRPS),
    Use permit for facilities, i.e. facilities for processing and/or disposal of waste issued in accordance with the law governing the construction of facilities,
  • A detailed description of the work process, which especially includes: - description of the location and identification of the source of risk (waste management method, types of waste), - equipment of the location of the plant, i.e. landfill in terms of pollution prevention and control, - technological procedure and equipment of the plant, i.e. landfill.
  • About the location (real estate deed or lease agreement and copies of previously obtained permits)
  • Monitoring program and method of reporting on: waste composition, gas emissions, waste water quality, groundwater quality, surface water quality, suspended particles, noise, unpleasant odors, the number and reduction of the number of pests and birds, and waste distribution,
  • Plan for protection and rescue in the event of an accident and a certified fire safety report in accordance with the law.
  • Proposal of a plan for the closure and maintenance of the landfill or facility after closure in accordance with the law.
  • Environmental impact assessment for the facility.

Special requirements for qualifications

  • The waste processor should have an employed manager of the waste processing plant with a completed university degree - VII degree of technical direction and at least 5 years of work experience in the profession,

  • one employed person with a completed at least III degree vocational qualification in the following jobs:

reception and collection of accepted waste, processing or disposal of accepted waste and management of the rest of processing or waste disposal.

  • As an exception to paragraph 1 of this article, a processor of non-hazardous waste with a processing facility capacity of less than 250 tons should have an employed manager with a completed secondary education.

Legal remedies

An appeal against a permit for poultry and/or waste disposal can be lodged with the Ministry of Tourism, Ecology, Sustainable Development and Development of the North within 15 days from the day of its receipt and through this authority.
