Registration in the Register of Sports Organizations and approval of the statute

The service is provided through a procedure that is intended for a sports organization that received a decision from the Ministry that established the fulfillment of the conditions for the establishment of a sports organization.
License conditions
The sports organization is obliged to submit to the Ministry within 30 days from the date of adoption of the decision on establishment a request for approval of the staut.
Along with the request, the party is obliged to submit the draft statute of the sports organization

There are no special conditions

The administrative fee for this service is €50.

Relevant regulations
Article 52 of the Law on Sports ("Official Gazette of Montenegro", number 44/2018 and 123/21),
Law on Administrative Procedure ("Official Gazette of Montenegro", no. 56/14, 20/15, 40/16 and 37/17),
Law on Administrative Fees ("Official Gazette of Montenegro", No. 18/19).
Permits
The institution is obliged to process the submitted Application and make a decision within 30 days.
If the documentation is incomplete, the Ministry of Sports and Youth, in accordance with the Law on Administrative Procedure, sends a request for supplementing the documentation to the applicant and leaves a deadline (from 3 to 8 days) for supplementing it. If the party does not complete the documentation within the set deadline, an additional deadline (from 3 to 5 days) is given to complete the documentation. If the specified deadline is not met, the request is rejected.
If during the procedure it is established that there is a reason for rejecting the request, the Ministry will enable the party to participate in the procedure before issuing a decision on rejection. The deadline for making a decision is 30 days from the date of submission of the request.
If the prescribed conditions are met, the statute is approved. Enrollment in the Register is carried out in the electronic database - the Central Register for Sports (CRSO).
Legal remedies
The party has the right to file a complaint with the Administrative Court of Montenegro (Bulevar Svetog Petra Cetinjskog 130, Podgorica) within 20 days from the date of receipt of the Decision. The deadline for the decision of the competent authority is 30 days from the day of receipt of the formal complaint. In the course of the lawsuit, if the first-instance authority sees new facts, there is a possibility of making a new decision, i.e. of a positive decision, which ends the legal proceedings.
