Sports organizations and sports activities

The service is provided through a procedure intended for a natural and/or legal person who submits a request for the establishment of a sports organization. The founder of a sports organization can be a domestic or foreign natural or legal person capable of doing business. The same person (natural or legal) can be the founder of only one sports organization in the same type of sport. The founder of a sports organization cannot be a natural person whose family member is the founder of another sports organization of the same type of sport. The founder of a sports organization cannot be a person from Article 62 of the Law on Sports

License conditions

The party submits a request for the establishment of a sports organization to the Ministry of Sports and Youth.

Along with the application, the party must submit the following documents:

  • Act on the establishment of a sports organization, which must be signed by all founders and certified in accordance with a special law;
  • Evidence of fulfillment of the conditions for performing sports activities;
  • For offices or a sports facility: a document proving the legal basis for the use of an office or a sports facility (real estate deed, lease agreement, service contract, agreement on assignment of use, or other legal document proving use on the basis of a permitted legal transaction) .
  • certified contract on engaged professional staff and persons to perform professional work in sports, and evidence of the fulfillment of the conditions for performing the work of a coach, namely:
  • a license to perform coaching duties and one of the following proofs:
  • proof of the acquired VI or VII1 level of the national qualification framework in the field of sports, i.e. physical education;
    a decision on the established status of an athlete with a top representative result in that type of sport; or
    confirmation from the competent national sports association that, as an athlete, he has been involved in that type of sport for at least 10 years.
  • Exceptionally, if there are no persons who meet the aforementioned conditions for a certain field of sport, it is necessary to submit proof of the acquired level IV of the national qualification framework and proof of fulfillment of the special conditions for that type of sport prescribed by the competent national sports federation, i.e. a license to perform the work of a coach.

If there is no competent national sports association, the license is issued by COK or POK.

  • For sports equipment - a statement from an authorized person representing the founder that the sports club, sports club, or sports recreation club has appropriate sports equipment, as well as a list of that equipment.

Rulebook on closer conditions for the establishment of a sports organization and the performance of sports activities ("Official Gazette of Montenegro", No. 85/18).

Legal remedies

The party has the right to file a complaint with the Administrative Court of Montenegro (Bulevar Svetog Petra Cetinjskog 130, Podgorica) within 20 days from the date of receipt of the Decision. The deadline for the decision of the competent authority is 30 days from the day of receipt of the formal complaint. In the course of the lawsuit, if the first-instance authority sees new facts, there is a possibility of making a new decision, i.e. A positive decision, which ends the legal proceedings.
