Employment contract with a foreigner

A foreigner can be employed or work in Montenegro on the condition that he has been issued a permit for temporary residence and work or a certificate of employment registration, unless the Law on Foreigners prescribes otherwise.

The permit for temporary residence and work and the certificate of foreigner's work application are issued by the Ministry of the Interior.

License conditions

Obligations of the employer:

 

  1. Applying for a job vacancy to the Employment Office of Montenegro;
  2. Public advertising by the Employment Office of Montenegro is carried out at the request of the employer, as well as when it comes to vacancies in a company, public institution and other public service whose founder or majority owner is the state or local self-government unit;
  3. Conclusion of an employment contract before starting work, which includes:
  • name and seat of the employer;
  • name and surname of the employee, place of residence, that is, residence of the employee;
  • unique identification number of the employee, i.e. personal identification number in case the employee is a foreigner;
  • qualification of the level of education, that is, the professional qualification required for that position;
  • job title and job description that the employee should perform;
  • place of work;
    the time for which the employment contract is concluded (indefinite or fixed term);
  • the duration of a fixed-term employment contract and the basis for concluding a fixed-term employment contract;
  • day of starting work;
    working hours (full, part-time or reduced);
  • the length of paid leave and annual leave to which the employee is entitled or, if this cannot be specified, the method of determining paid leave and annual leave;
  • the length of the notice period in case of termination of the employment contract;
  • names of collective agreements applied by the employer;
  • the amount of the coefficient, the amount of the basic salary, the basis for increasing the salary, the time of salary payment and other income of the employee;
  • rights, obligations and responsibilities of the employee and the employer related to protection and health at work;

4. The employment relationship is considered to be based on the conclusion of the employment contract between the employee and the employer and the employment of the employee;
5. Application for mandatory social insurance on the day of starting work and to submit the application to the competent authority within 8 days from the day of starting work.
