License conditions

• a business company, i.e. an entrepreneur, can engage in the wholesale trade of tobacco products if it is registered in the CRPS;
• meets the prescribed minimum technical requirements for the wholesale trade of goods;
• has appropriate space and equipment for the storage of tobacco products, a storage space for the wholesale of tobacco products (cigarettes), must have a total area of ​​at least 400 m2 with a height of at least 2.8m, and a storage space for the wholesale of other tobacco products (cigars , cigarillos...) must have a total area of ​​at least 15m2 and a height of at least 2.8m.
• to have a means of transport for the unhindered supply of cigarettes to retailers in the territory of Montenegro, with a total load capacity of at least 5 tons, with the fact that the load capacity of an individual means of transport cannot be less than 300 kg. For the supply of other tobacco products, at least one means of transport must be available, the carrying capacity of which cannot be less than 300 kg. The means of transport used to transport tobacco products must be marked with a special label.
• has concluded a contract on the supply of tobacco products with a registered manufacturer, that is, an importer of tobacco products;
• that the company/entrepreneur and responsible person in the company, in the last three years preceding the submission of the application for the issuance of the approval, has not been convicted of the criminal offense of illegal trade, that is, of the criminal offense of illegal production of tobacco, processed tobacco and tobacco products;
• pay a fee in the amount of 150,000 euros for the wholesale sale of tobacco products, and for the wholesale sale of other tobacco products (cigars, cigarillos...) a fee in the amount of 30,000 euros;
• pay an administrative fee of 50 euros for a decision on the fulfillment of the conditions for conducting wholesale trade in tobacco products, or 20 euros for conducting wholesale trade in other tobacco products;
• pay an administrative fee of 10 euros for registration in the register of tobacco wholesalers;
• request for the issuance of authorization for the wholesale trade in tobacco products.

The fee for issuing an authorization for the wholesale trade of tobacco products can be paid in five annual installments.

Special requirements for qualifications

Proofs

• proof of registration in CRS - registration decision;
• proof of the fulfillment of minimum technical conditions - trade report certified by the Department for Market Inspection;
• for the storage area, proof of the right of ownership, i.e. lease, real estate deed, sketch of the warehouse with a precisely marked part leased for the storage of tobacco products;
• for means of transport, proof of the right of ownership, that is, the right to use the means of transport, with copies of the traffic permit(s);
• concluded a contract with a registered producer/importer of tobacco products;
• evidence from criminal record - Ministry of Justice;
• proof of payment made.

Fees

License/authorization: EUR 150,000 for wholesale tobacco products, or EUR 30,000 for other tobacco products;
Administrative fee: EUR 50 for a decision on the fulfillment of the conditions for wholesale trade in tobacco products, or EUR 20 for wholesale trade in other tobacco products;
Administrative fee: 10 EUR for registration in the register of wholesalers of tobacco products;
Administrative fee for issuing a certificate from the criminal records of the Ministry of Justice: 3 EUR (per certificate).
