License conditions

• a business company, i.e. an entrepreneur has the right to participate in a public tender for the issuance of approval for the production of tobacco products if it is registered in the CRPS;
• has appropriate premises that meet the prescribed conditions for the production and accommodation of tobacco products;
  has equipment that enables him to carry out production in all stages from preparation (moistening, sorting, cutting, flavoring) to the production of tobacco products and their hygienic packaging;
• has the capacity to produce cigarettes from its assortment of at least 1,000,000,000 pieces per year (this item does not apply to the production of other tobacco products);
• has an appropriate laboratory for the analysis and determination of the quality of tobacco products or has concluded a contract with an authorized laboratory for the analysis and determination of the quality of tobacco products;
  employs appropriate professional staff for the production and quality control of tobacco products;
• offer a realistic assessment of the realization of the annual production of tobacco products produced according to the appropriate quality and quantity;
• that the business company/entrepreneur and the responsible person in the business company, in the last three years preceding the announcement of the public tender, have not been convicted of the criminal offense of illegal production, that is, of the criminal offense of illegal trade in tobacco, processed tobacco and tobacco products;

Special requirements for qualifications

The company, that is, the entrepreneur who is the first on the final list of bidders for the issuance of approval for the production of tobacco products, is obliged to submit:

• a contract concluded with a tobacco processor;
• pay a fee for the production of cigarettes in the amount of EUR 300,000, and for the production of other tobacco products, a fee in the amount of EUR 100,000;
• pay an administrative fee of EUR 150 for a decision on the fulfillment of the conditions for carrying out the production of tobacco products;
• pay an administrative fee of 10 euros for registration in the register of producers of tobacco products;

The right to participate in the public tender belongs to the business company, i.e. the entrepreneur who, together with the application for participation in the public tender, submits a detailed project, which provides for the method and deadlines for fulfilling the above-mentioned conditions, with an explanation of the project, the determined amount of financial resources required for the realization of the project, a bank guarantee for that amount, i.e. proof of other means of security from the bank.

The fee for issuing the authorization for the production of tobacco products can be paid in five annual installments.

Fees

License/approval: EUR 300,000 for the production of cigarettes, or EUR 100,000 for the production of other tobacco products

Administrative fee: EUR 150 for a decision on the fulfillment of the conditions for carrying out the production of tobacco products

Administrative fee: 10 EUR for registration in the register of producers of tobacco products;

Administrative fee for issuing a certificate from the criminal records of the Ministry of Justice: 3 EUR (per certificate).
