Management of technical control and technical control (auditing) of mining projects and individual parts of mining projects

Mining projects are subject to technical control (audit).
The audit of the main and supplementary mining projects is carried out by the competent authority through an expert committee or a legal entity (hereinafter referred to as the auditor) that has a license to develop mining projects.
The audit of the simplified mining project can be carried out by the investor through an expert committee or an auditor.
The costs of the audit are borne by the project investor.

License conditions

• based on the license for mining projects, the auditor can audit the main, supplementary and simplified mining projects;
• the project auditor should be registered (activity code) for the development and technical control of mining projects;
• the license for the development of mining projects, management, technical control and auditing of mining projects is issued by the Ministry in charge of mining (hereinafter: the Ministry) based on the request of the company;
• The request for the issuance/verification of a license for the development of mining projects is a free form;
• the license is issued for a period of 5 (five) years and certified every year;
• managing the technical control of mining projects can be performed by a person who has a high school diploma in the mining profession, 5 (five) years of work experience in technical management, supervision and other professional tasks in mining facilities for which the project is being developed;
• the technical control of certain parts of mining projects can be performed by a person who has a high school diploma in the appropriate profession, 3 (three) years of work experience in technical management, supervision and other professional jobs in mining facilities for which the project is being developed;
• the audit of mining projects can be performed by a person who has passed the professional exam for performing work in the field of mining - authorization, organized by the Ministry;
• Mining projects carried out abroad are subject to technical control, that is, a check is made as to whether the applied regulations, measures and conditions used for the preparation of project documentation correspond to the regulations applied in Montenegro;
• Audit of the main and supplementary mining project cannot be carried out by: the holder of the project (business company-legal entity) and the investor, persons who are employed by the holder of the project, persons employed by the investor on the tasks of developing mining projects. Audit of mining projects (main, supplementary and simplified) cannot be performed by persons employed in the Ministry;
• The auditor confirms with the revision clause on the mining project that the revised project was prepared in accordance with the law;
• The audit clause contains the name, surname and signature of the person who audited the project and certain parts of the project, and if the audit is performed by a legal entity, the clause is also certified by the signature and seal of the authorized person who audited;
• Along with the audited project, the auditor shall attach a report on the audit of the mining project and proof that the persons who audited the mining project have the authority to perform these tasks, that is, they have passed the professional exam in the field of mining.

Special requirements for qualifications

- evidence - an extract from the Central Register of the Commercial Court on the registration of a business company for the development of mining projects or parts of mining projects, for managing technical control or technical control of parts of mining projects;
- proof that there are at least 2 (two) graduate engineers in the mining profession in the appropriate field (employment contract, insurance application and certified photocopy of work book);
- proof of the required higher education as a mining engineer - certified photocopy of the faculty diploma;
- proof of the required length of service - confirmation of at least 5 (five) years of work experience in the performance of professional work in the development of mining projects or management of the control of mining projects;
- proof of the required length of service - confirmation of at least 3 (three) years of work experience in the performance of professional work on the development of parts of mining projects or technical control of mining projects;
- proof of passing the professional exam - a certified photocopy of the Certificate issued by the Ministry;
- For a foreigner employed in a company, graduate mining engineer: he must have a residence permit in accordance with the law regulating the employment and work of foreigners, it is necessary to submit a certified photocopy of the passport and a certified photocopy of the appropriate license from the country of origin, instead of a certificate of passing a professional the exam.

Fees

License – €600 for issuance
License - €200 for certification
Taking a professional exam: the costs of taking the exam, as a rule, are borne by the company where the candidate is employed. If the costs of taking the exam are not borne by the company in which the candidate is employed, the costs are borne by the candidate. (Article 11 of the Rulebook on the program and method of taking a professional exam in the field of mining).
The Commission for taking the professional exam in the field of mining, which is established by the Ministry by Decision, informs the candidate of the amount of expenses.
In the earlier period, the costs of taking the professional exam amounted to around €200, per candidate.
