License conditions

Article 193 of the Law on Spatial Planning and Construction of Buildings prescribes the conditions for obtaining a decision on fulfilling the requirements for performing the duties of an authorized engineer for a complex engineering facility, and that the decision is issued to persons who have at least three years of work experience in the professional work of creating technical documentation and/or construction of a complex engineering facility.

Article 194 of the Law on Spatial Planning and Construction of Buildings prescribes the conditions for obtaining a decision on meeting the requirements for performing the duties of an auditor, expert supervisor and technical review for a complex engineering facility, and that the decision is issued to persons who have at least four years of work experience in professional construction work. technical documentation and/or construction of a complex engineering facility in the capacity of an authorized engineer.

The following documentation is submitted with the request to obtain a decision for an authorized engineer for a complex engineering facility:

• license of an authorized engineer for the performance of technical documentation and building construction activities;
• proof of fulfillment of the requirements of at least three years of professional work experience in the preparation of technical documentation and/or construction of a complex engineering object for which the application is submitted (signed and certified statement of the investor and/or employer with a reference list);
• photocopy of the identity card;
• proof of work engagement of a natural person with a legal entity that issued proof of fulfillment of conditions regarding work experience (photocopy of work book, photocopy of work contract or similar);

The following documentation is submitted along with the request for obtaining a decision on the work of the auditor, professional supervisor and technical review for a complex engineering facility:

• auditor's license for auditing technical documentation and professional supervision of building construction;
• proof of fulfillment of the requirements of at least four years of work experience in professional work in the preparation of technical documentation and/or construction of a complex engineering object for which the request is submitted (signed and certified statement of the investor and/or employer with a reference list);
• photocopy of the identity card;
• proof of work engagement of a natural person with a legal entity that issued proof of fulfillment of the requirements regarding work experience (photocopy of work book, photocopy of work contract or similar);
• the application fee, which is paid in the amount of 2 euros per tariff number 1, as well as the fee for issuing a decision in the amount of 3 euros per tariff number 4 of the Law on Administrative Fees ("Official Gazette of Montenegro", No. 18/2019) on giro account no: 832-3161018-57 (administrative fee - Ministry of Capital Investments).

The following documentation is submitted with requests for a decision:

• Extract from the CRPS of the company proposed as the auditor of the technical documentation/technical review/professional supervision for the complex engineering facility;
• Auditor's license and professional supervision of the business company proposed for performing the activity;
• Liability insurance policy in accordance with the Regulation on the minimum amount of professional liability insurance in the field of building construction ("Official Gazette of Montenegro", No. 68/2017).
• Decisions that determine the fulfillment of the requirements for performing the duties of auditors, professional supervision and technical inspection for a complex engineering facility of engineers participating in the activities according to the type of complex engineering facility;
• Statement of the investor, contractor and expert supervisor;

Along with the request for issuing a permit for research and measurement of the potential of renewable energy sources, the applicant submits:

• an extract from the Central Register of Business Entities (hereinafter: CRPS) or another appropriate register, if the applicant is a legal entity;
• a copy of the personal identification document, if the applicant is a natural person or an entrepreneur;
• an extract from the CRPS, that is, another appropriate register, for the legal entity with which the applicant has concluded a contract on research and measurement of the potential of renewable energy sources;
• technical description of research and measurement of renewable energy source potential with a list of measuring equipment and devices, measurement program and methodology for processing measurement data, i.e. calculation of renewable energy source potential;
• graphic representation of the measurement location with the measurement point drawn;
  location data for research and measurement (site boundaries, municipality, cadastral municipality, cadastral plot, cadastral plan);
• property sheet for cadastral parcels on which measuring devices are planned to be installed at the measuring location;
• proof of settled property-legal relations for the measuring place, i
• proof of the professional staff of the legal entity that will carry out research and measurement of the potential of renewable energy sources.

Legal remedies

The appeal does not delay the execution of the decision. Against this decision, an administrative dispute can be filed with the Administrative Court of Montenegro within 20 days from the delivery of the decision.
