Execution of mining works and exploitation of mineral raw materials

License conditions

  • the exploitation of mineral raw materials can be carried out by a company with the capacity of a legal entity (hereinafter referred to as a company) that has a license to carry out mining works;
  • The license for the performance of mining works is issued by the Ministry responsible for mining (hereinafter referred to as the Ministry) based on the request of the company;
  • The request for the issuance/certification of a license for the performance of mining works is a free form;
  • the license is issued for a period of 5 (five) years and certified every year;
    the company should be registered (activity code) for the exploitation of mineral raw materials and/or similar activities;
  • that there is at least one mining engineer and the required number of engineers of the appropriate profession in the employment relationship, in accordance with the Act of the Company;
  • the technical manager of the plant or individual technical services must be a mining engineer with at least 3 (three) years of work experience in the profession and a passed professional exam for performing mining works;
  • the technical manager of the electrical, i.e., mechanical service or construction works performed for the exploitation of mineral raw materials should have a suitable technical faculty or a suitable higher technical school, two or three years of work experience in the profession and a passed professional exam;
  • mine detonator and operator in warehouses of explosives - III degree of education in mining, three years of work experience in the profession in appropriate jobs and passed the mine detonator exam;
  • the company should have the appropriate technical equipment for the performance of mining works, and in accordance with the technical documentation (exploitation feasibility study or the main mining project);
  • in order to obtain permission for exploitation under the main and supplementary mining project from the Ministry, the business company addresses the Ministry with a request;
  • the performance of works on the exploitation of mineral raw materials, and upon obtaining approval for exploitation, can only be carried out on the basis of approved mining projects;
  • along with the request for approval for exploitation, the company submits the contract on the concession for the exploitation of mineral raw materials, which it signed with the Ministry - Government of Montenegro, as the grantor;
  • exploitation of mineral raw materials can also be carried out by foreign legal entities, but in accordance with the law governing the employment and work of foreigners in Montenegro.

Special requirements for qualifications

  • evidence - an extract from the Central Register of the Commercial Court on the registration of a business company for performing mining works;
  • approved Concession Agreement for the exploitation of mineral raw materials;
  • approval for the performance of mining works;
  • proof of employment, that is, of the employment relationship of a graduate engineer in the mining profession in the appropriate field (employment contract, insurance application and certified photocopy of work book);
  • proof of the required higher education of a mining engineer - certified photocopy of the faculty diploma;
  • proof of the necessary work experience of a mining engineer - a certificate of at least 3 (three) years of work experience in performing professional tasks in the execution of mining works for which the issuance of a license is requested;
  • proof of passing the professional exam - a certified photocopy of the Certificate issued by the Ministry;
  • evidence that the company has the appropriate equipment for performing mining works - an extract from the inventory list of fixed assets and the statement of the responsible person in the company about the availability of the equipment;
  • consent of the Ministry to the Act on the internal organization and systematization of the company, which determined the required number of engineers of the appropriate profession for the performance of mining works;
  • For a foreigner employed in a company, graduate mining engineer: must have a residence permit in accordance with the law regulating the employment and work of foreigners, a certified photocopy of the passport and a certified photocopy of the corresponding license from the country of origin must be submitted, instead of a certificate of passing a professional exam .

License – €600 for issuance

License - €200 for certification

Taking the professional exam: the cost of taking the exam, as a rule, is borne by the company where the candidate is employed. If the costs of taking the exam are not borne by the company where the candidate is employed, the costs are borne by the candidate. (Article 11 of the Rulebook on the program and method of taking the professional exam in the field of mining).

The Commission for taking the professional exam in the field of mining, which is established by the Ministry by Decision, informs about the amount of the candidate's expenses.

In the earlier period, the costs of passing the professional exam amounted to around €200, per candidate.
